Abstract

It is hereby presented a critical reading of IUS/LEX. Hobbes e il diritto naturale by Tommaso Gazzolo. Gazzolo's study seeks for an heterodox reading of Thomas Hobbes' philosophy of law. The thesis here advanced is that the relation between ius and lex, whether conceived as internal to juridicity itself, can lead to a natural law that is not opposed nor superior to positive law. This thesis is supported via several steps: the interrogation of Hobbesian natural law; the analysis of the relationship between faculty and power; the study of the concept of self-preservation; the demonstration of the circularity of the relationship between ius and lex.
